Section 278 legal agreements

A Section 278 Agreement is applicable to all works involving modifications within the existing public highway. Once you have been granted the planning permission and wish to proceed to the next stage of your proposed works on the public highway whether that entails making amendments to an existing footway area or proposing a new junction onto the existing network, the highway authority requires a detailed design submission for approval. This submission typically includes, but is not limited to, the following components:

• General Arrangement Plans
• Site Clearance Plans
• Safety Fencing and Vehicle Restraint Systems (VRS)
• Drainage Design
• Levels Layout (including contours plan)
• Earthworks (Cut & Fill)
• Pavement Construction and Carriageway Surfacing
• Kerbs, Footways, and Cycleways
• Traffic Signs and Road Markings (including Signage Schedule)
• Traffic Signals
• Street Lighting and Electrical Works
• Existing Utilities and proposed diversions
• Landscaping Plans
• Swept Path Analysis (Auto Track Runs)
• Visibility Splays at Junctions
• Extents of proposed Traffic Regulation Orders (TRO)
• Site Location Plan showing application site/development layout and Section 278 highway work extents
• Standard Construction Details
• Cross Sections and Long Sections
• Specifications compliant with the Manual of Contract Documents for Highway Works

Section 106:  Request to obtain permission from the relevant sewerage undertaker to connect new developments or alterations to existing developments to the public sewerage system.
